“It’s not every day that you see Big Tech collide with the nineteenth century. But that’s just what happened on September 24, 2023, when a federal district court blocked a New York City ‘commission cap’ law. On its face, the law limited fees charged to restaurants by certain app-based delivery platforms. But the platforms sued the city over the law, arguing that it was fundamentally discriminatory. They argued that the city had used the law as a smokescreen to transfer wealth from them to local business interests. And to the surprise of many, the district court agreed. The court held that the platforms had plausibly alleged that the city council had singled them out to favor local constituents. And that kind of targeted regulation exceeded the city’s authority under its ‘police power.'” (02/10/25)
