“President-elect Donald Trump’s recent threats to evade Senate consent by installing his cabinet picks via recess appointments have received significant attention and justified outrage. As I’ve explained elsewhere, it would be a grave mistake for the Senate to abdicate its confirmation role, and it would be illegal for the president to force a recess. Fortunately, it seems more likely that Trump’s threat of recess appointments will remain only a threat. But there is a less high-profile means of evading Senate consent that should receive far more attention: the Vacancies Act. The president-elect heavily abused the Vacancies Act in his first term, and he is very likely to do so again in his second term.” (12/11/24)
